Public Defender

The services of the Public Defender originated, developed, and grew from a shared belief by all Americans in individual freedom. To protect this shared belief in freedom, the United States and California Constitutions provide the right to choose government representatives and the right to due process of law. Among the rights guaranteed by the United States and California Constitutions is the right of an accused to counsel. The Sixth Amendment to the United States Constitution provides, in relevant part, “In all criminal prosecutions, the accused shall enjoy the right to…the Assistance of Counsel for his defence.” (See also Art. I, Sect. 15, Cal. Const.)

Recognizing that impoverished people could not afford counsel, the United States Supreme Court stated, “The right of one charged with crime to counsel may not be deemed fundamental and essential to fair trials in some countries, but it is in ours. From the very beginning, our state and national constitutions and laws have laid great emphasis on procedural and substantive safeguards designed to assure fair trials before impartial tribunals in which every defendant stands equal before the law. This noble ideal cannot be realized if the poor man charged with crime has to face his accusers without a lawyer to assist him.” (Gideon v. Wanwright (1963) 372 US 335)

As Public Defender of Shasta County, I am committed to providing experienced, knowledgeable, and skilled attorneys to indigent individuals charged with crimes in order to guarantee their right to a fair trial. Our attorneys guide their clients by offering wise legal counsel based on actual jury trial experience. Attorneys utilize a talented investigative team to vet witness statements and present defenses at trial. Once the prosecution evidence is rigorously tested, our social workers commence the process of delivering rehabilitative services designed to assist our clients overcome addiction, treat mental illness, live meaningful lives, and reunite with their families.

The work we do at the Office of the Shasta County Public Defender is essential to maintaining the freedom uniquely found in America. Although we are selective in those we choose as members of our team, we encourage the resilient few with a passion for justice to seek out an opportunity with us.
