Commercial Organics Waste Collection Exemption Application

Assembly Bill (AB) 1826 and Senate Bill (SB) 1383 require businesses and multifamily complexes (5 units or more) that generate a specified amount of solid waste per week to arrange for organic waste recycling. However, the laws allow for case-by-case exemptions if businesses and multifamily complexes meet specific exemption criteria. Please complete and submit this application for review to see if your business or multifamily complex qualifies for an exemption. DE MINIMUS EXEMPTION
An exemption is requested as this business generates minimal organic waste. If yes is marked, please answer the additional questions below regarding how much waste is generated and type.

SELF-HAUL EXEMPTION
Due to self-hauling, the commercial business’s weekly organic waste production is less than the deminimus threshold. Self-hauling can include but is not limited to landscaping companies that self-haul trimmings to a certified composting facility, food donations to people or animals, self-hauling to a certified composting facility, and/or on-site composting. The commercial business will provide, upon request, documents demonstrating that the material collected is not landfilled. This may include a landscaping contract, a statement from the collector, delivery receipts, and weight tickets (if supplied) from entities receiving organic materials.
SELF-HAUL EXEMPTION
PHYSICAL SPACE EXEMPTION
There is a lack of sufficient space for storage or service of hauler-provided Trash and Organic Waste Containers. The commercial business will provide, upon request, supporting documentation that demonstrates the lack of space.
OTHER - LIMITED TERM EXEMPTION
Limited-term exemptions for extraordinary and unforeseen event(s). Ex. Fire
