Commercial Recycling & Organics Waste Collection Exemption Application

Assembly Bill (AB) 341 and AB 1826 require businesses and multifamily complexes (5 units or more) that generate a specified amount of solid waste per week to arrange for organic recycling and recycling services, respectively. However, the law allows for case-by-case exemptions if businesses and multifamily complexes meet specific exemption criteria. EXISTING ALTERNATIVE SERVICE EXEMPTION
A person or organization provides recycling and/or organics collection service, reducing the weekly organic waste produced to below the de minimus threshold. This can include but is not limited to paper shredding and collection services, landscaping companies that haul away trimmings to a recycling facility, food donations to people or animals, self-hauling to a recycling facility, and/or on-site composting. The Commercial Business will provide, upon request, documents demonstrating that the material collected is not landfilled. This may include a landscaping contract, a statement from the collector, etc. If the Commercial Business self-hauls recyclables and/or organics it will provide, upon request, delivery receipts, and weight tickets (if supplied) from each entity receiving recyclables and/or organic materials.
PHYSICAL SPACE EXEMPTION
There is a lack of sufficient space for storage or service of hauler-provided Blue and/or Green Containers. The commercial business will provide, upon request, supporting documentation that demonstrates the lack of space.
